Terms and Conditions

1. General

Pettersson Elektronik AB’s (“Pettersson, “we”) Terms and Conditions apply to delivery of products and/or services to customers. These Terms and Conditions apply unless otherwise agreed upon in writing.

2. Prices

Current prices are displayed on Pettersson’s website. The prices are specified in SEK and do not include VAT unless otherwise stated. Prices specified in other currencies are only intended to be indicative. The prices displayed on Pettersson’s website are valid only for purchases made in our web shop. Other purchases, e.g. purchases made through a purchase order, may be subject to a different pricing.

VAT is added to the specified prices for deliveries to customers in Sweden and to customers in the EU without a valid VAT number. For deliveries to customers in the EU with a valid VAT number and to customers in other countries, no VAT is added. 

For export sales (outside the EU), customs and other import related fees may apply. All such fees are to be paid by the customer unless otherwise agreed upon in writing. 

Shipping costs are added. 

Prices are subject to change without prior notice. Extra charges may apply in cases where the customer requires us to register to and/or utilize an external purchasing system, requires us to provide special documentation or in procurements.

3. Terms of payment

Customers who have been granted a credit by Pettersson are offered payment by invoice, normally 30 days net. For other customers, the payment conditions are by Visa/Mastercard or advance payment.

4. Order

By making a purchase from Pettersson, the customer agrees to these Terms and Conditions and, through these, also to Pettersson’s Integrity policy. Orders are usually processed and shipped within 5 business days. If your order contains one or more back-ordered item(s), we will contact you with information regarding the expected time until shipping.

Shipping to certain countries may be subject to restrictions and in such case we may not be able to fill the order.

Orders from UK consumers with a value of GBP 135 or less (excl. VAT) are not accepted.

5. Damages during shipping

The customer are to carefully examine the delivered goods upon reception. In order to claim that a product/delivery is faulty, the customer should immediately file a complaint with Pettersson, no later than 15 days from the invoice date. 

6. Cancelling and returning an order

Consumers have the right to cancel and return purchased goods within 14 days of receiving the goods for a full refund, for any reason and without a justification. The goods must be in as new condition and include all supplied items, including packaging. Please note that the customer will bear any shipment cost of returning the goods. Goods delivered electronically (e.g. software) cannot be returned.

7. Returning a faulty product

Before a faulty product is sent to Pettersson, the customer must contact Pettersson to obtain an RMA number, and fill in a Return Form, which is available on Pettersson’s website, www.batsound.com. The Return Form is to be attached to the faulty product. Products that are returned without a complete Return Form (with RMA number) may be sent back to the customer without any action, at the customer’s expense. 

The issuance of an RMA number does not implicate that Pettersson has approved any type of action for a product.

8. Warranty 

Goods (products) purchased from Pettersson are covered by the following warranty. 

This limited warranty covers defects in materials and workmanship in the product for a period of one year from the date of purchase. In order for the warranty to be granted, a proof of purchase (normally the original invoice/receipt) is required and the serial number label must not be removed from the product. 

Pettersson will repair or replace the product if it proves to be defective during the warranty period, provided it is returned to Pettersson at the customer’s expense and risk. 

Pettersson may elect to replace a defective product with a similar product deemed by Pettersson to perform substantially the same function as the original product. 

Before returning a defective product to Pettersson, the customer must contact Pettersson to obtain a return authorization number (RMA) and return shipping instructions. After repairing/replacing a product under warranty, Pettersson will return it to the customer at Pettersson’s expense and risk. 

A Pettersson product does not contain any user-serviceable parts. Do not open it and always refer servicing to the manufacturer or any other party authorized by the manufacturer.

No other warranty is expressed or implied. 

Some examples of what is not covered by the limited warranty:

1. Damage, deterioration or malfunction of the product resulting from abuse and misuse, including but not limited to (a) the failure to use the product for its normal purpose or in accordance with Pettersson’s instructions on the proper use and maintenance of the product and (b) the installation or the use of the product in a manner inconsistent with the technical or safety standards in force in the country where the product is used.

2. Damage, deterioration or malfunction of the product resulting from unauthorized tampering with the product or modifications made to the product.

3. Damage, deterioration or malfunction of the product resulting from repairs done by a person unauthorized by Pettersson to make such repairs.

4. Damage, deterioration or malfunction of the product resulting from accidents or similar causes beyond the control of Pettersson, including but not limited to lightning, power surge, water, fire and public disturbances.

5. Damage, deterioration or malfunction of the product resulting from causes which do not relate directly to a defect in materials and workmanship of the product.

The above list is not complete and should only be regarded as examples of damages etc. not covered by the warranty. 

9. Limitation of liabilities 

In no event shall Pettersson be liable for any special, incidental or consequential damages of any nature including, but not limited to, damages resulting from loss of profit or revenue, claims for service interruptions or failure to supply downtime, testing, installation or removal costs, costs of substitute products, property damage, personal injury, death or legal expenses. 

The customer’s recovery from Pettersson for any claim shall not exceed the purchase price paid by the customer for the goods/services, irrespective of the nature of the claim, whether in warrant, contract or otherwise. The customer shall indemnify, defend and hold Pettersson harmless from any claims brought by any party regarding products supplied by Pettersson and incorporated into the customer’s product. 

Pettersson assumes no responsibility for any loss or claims by third parties which may arise through the use of the product. 

Pettersson assumes no responsibility for any damage or loss caused by deletion of data as a result of malfunction, repairs or battery replacement. Be sure to back up all important data on other media to protect against its loss.

10. Product safety notice and restrictions 

Pettersson products are intended for commercial use only. They are not designed, intended or authorized for use in life support, life sustaining, human implantable, nuclear facilities, flight control systems, or other applications in which the failure of such products could result in personal injury, loss of life or catastrophic property damage. If the customer uses or sells the products for use in any such applications: (1) the customer acknowledges that such use or sale is at the customer’s sole risk; (2) the customer agrees that Pettersson is not liable, in whole or in part, for any claim or damage arising from such use; and (3) the customer agrees to indemnify, defend and hold Pettersson harmless from and against any and all claims, damages, losses, costs, expenses and liabilities arising out of or in connection with such use or sale.

11. Waste disposal

Worn-out electric products must be disposed of properly. If you have a Pettersson product that you wish to dispose of, you agree to send the product to us with our free return service. For more information about this, please contact Pettersson at info@batsound.com.

12. Software/Firmware License Restrictions

The following restrictions apply to all Software and Firmware included in Pettersson products.

You may not sublicense, modify, reverse-engineer, disassemble or decompile all or part of the Software/Firmware, or otherwise attempt to derive the source code for the product. You may not use the Software/Firmware as an application development tool. You may not create, copy, sublicense or distribute a library derived from the Software/Firmware. All Software/Firmware are the copyright of Pettersson.

13. Applicable Legislation and Dispute resolution 

Swedish legislation is applied to these Terms and Conditions. Disputes due to these Terms and Conditions are primarily to be resolved by negotiation, and if the parts can’t unite, finally be decided by arbitration proceedings. These proceedings are to take place in Stockholm.

14. Force Majeure 

Neither party shall be liable for any failure or delay in performing its obligations under the contract to the extent that such failure or delay is caused by a Force Majeure Event. A Force Majeure Event means any event beyond a party’s reasonable control, which by its nature could not have been foreseen, or, if it could have been foreseen, was unavoidable, including strikes, lock-outs or other industrial disputes (whether involving its own workforce or a third party’s), failure of energy sources or transport network, acts of God, war, riot, civil commotion, interference by civil or military authorities, national or International calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weatherconditions, or default of suppliers or subcontractors. 

15. Other 

Pettersson reserves the right to change any information, including but not limited to, prices, technical specification and product offers without prior notice. 

Information and prices are given with reservation to printing and typing errors, errors in technical specifications, increase in price by suppliers and end of sales. 

The information given on Pettersson’s website does not constitute any guarantee of merchantability or fitness for a particular purpose unless agreed to the customer in writing. 

Current offers are valid whilst stocks last, unless otherwise specified. 

The customer may not transfer the agreement or rights and duties attributable to the agreement without Pettersson’s written consent. 

Pettersson reserves the right to change these Terms and Conditions at any time.
